International Labour Day


International Labour Day - celebrate worker day as Labour Day all over International Labour Day as a support day of worker also called 1 May holiday.  



International Labour Day - Need for labour legislation is necessary for the following reasons as the factory system had some inherent evils to which the factory workers were exposed in the bargaining. 

The wages paid to factory workers where quite in head act to meet there barest need.


Workers were exposed to serious accident because machines were not properly screen and worker who were the unfortunate victim of accident lost their employment and had no right to compensation.

The employment of factory workers was not secure. Worker could be discharge , suspended or dismissed  at any time without assigning any reason therefore.

Work in the industries was hazardous with long hours duty , no rest and no recreations. 

The worker had no work in slums and under insanitary conditions which had its effect on health and morality of the workers.

Children and women where taking to work under hazardous condition of War and at odd hours.

Labour Laws follows everywhere in whole world should be based upon -

Social Justice:- it means an equitable distribution of profit and benefits of industry between the employer and worker and providing protection to the worker against harmful effects on their health safety and morality.


Social equality :- legislation based on Social Justice prescribed definite standard for adoption in future search standard is forced after taking into consideration the past and present circumstances once this standard is fixed by registration it cannot be changed unless the circumstances and conditions so warrant.


International uniformity :- International uniformity is another principle on which labour laws are based important role played by International Labour Organisation in the connections is praiseworthy this organisation AIMS at securing minimum uniform standard in respect of all labour matter.


National economy :-  while framing the labour laws the general economic situation of the country has to be kept in mind so that object may not be defected.

Labour Day And Imparting Specialised Training 



Labour Day


This Training Institute was approved third five years plan project for imparting specialised training to the officer engaged in the maintenance and promotion of industrial relation and enforcement of various labour laws the importance of such training need hardly be over - emphasized.

Our country after independence has embarked upon an ambition planned development program and we are more than half way the third five years plan the government have already approved the relative Framework for the fourth five years plan about which you must have already read in the newspaper in the context of objective envisaged in the plans dis maintenance of healthy Industrial Relation asms special significance hindrance to production in all field of economic activity have to be e minimised the meeting of the standing Labour Committee held at New Delhi on March 10 and 11 1960 therefore rightly recommended that provision should be made for training on the job as well as refresher training for officer of the Industrial Relations machinery.


Useful Scheme :-
This training project however had to face certain difficulty including the problem of its location and accommodation .

Foreign Trainees :-
This is the first time that training of this type will be given in India to Nominees of foreign governments in fact this Institute is the first of its kind in the country it is quite different from other institute for colleges affiliated to various universities which prepare students for diploma and postgraduate degrees in various social science labour welfare and Industrial Relations the difference lies in the fact that in the institute the teaching method for obvious reasons lay more emphasis on books and theory  and emphasis on practice and procedure is much less the lack of practical approach to the labour problems certainly is a factor which is responsible for the outlook of the person undergoing the training and who get their diplomas or degrees.

Every year number of important decisions are taken in the Indian labour conference standing Labour Committee and various industrial committee with regards to maintain affecting both employers and workers there are other voluntary agreement accepted by the representatives of the employer and workers search as the code of discipline inter Union code of conduct and industrial Truce resolution. 

With regards to the policy of the government and the decisions of the various wage boards and the Tripathi body on labour matters the role played by the officers who worked in the labour field whether they are Labour Commissioner conciliation officer labour officer for labour inspector is undoubtedly very significant the officers connected with the the enforcement of the labour laws must know the technique of inspection those who are entrusted with prevention and settlement of industrial dispute must know how to deal with the employers and the organisation of the worker and pursued them to adopt a reasonable approach for resolving their differences and disputes.

Conciliation :-

Conciliation is an art it calls for high quality and skill and a deep understanding of human nature many compliance and intricate situations are bound to arise which these officers have to face and for which they are required to find solution on the spot these techniques and procedures cannot be e learnt from books and they are not taught in Institute and colleges.

The officer who are undergoing training are actually doing this job and their discussion will be fruitful from the point of view of adopting a correct approach to the various problems.

Arbitration :-

In the industrial Truce revolution much trace has been laid on increase in the production and voluntary abbreviations and a good number of this could have been resolve the records to voluntary every station in the central sphere the regional Labour Commissioner conciliation officer and even some of the labour inspector I have acted as every stations successfully this was possible because proper instructions were issued to them and they were also given training as to how they should actually handle every stations cases.

Officers working in the labour field at Council later for labour Inspector And Labour officer have to shoulder heavy responsibility the possibilities of disappointment and discouragement are very great but they must not easily accept defeat they must have faith in human nature and also in the possibilities creating with the help of ordinary men and women employers and workers a better social and industrial order to do something towards this end is there real location the questions and problems which they are likely to call upon to deal with may often be new and without precedent to tackle them they must have physical courage as well as that born of conviction. 

They should be ready to face oppositions and to speak without fear or favour to the Employees as well as worker the training in this Institute will not only the incentive with practical based on various aspects of jobs to be done by the officers in their respective capacities but will give them an opportunity for exchange of views ideas and experience the provision of short refresher course has a definite purpose as they would enable the officer to keep themselves active and their knowledge up to date.


Incentive Training :-

The officer undergoing training derived considerable advantage from their visit to various important industrial undertaking at places like Mumbai Ahmedabad Calcutta Dhanabad Hyderabad. 

While the offices where visiting one of the public sector undertaking a senior officer with whom they were having discussion mention that they would like to depute there officer for training in this Institute the government has also approve the arrangement or short two weeks course for the benefit of officers.


The expert on labour problem who are invited to talk ok in the institute will undoubtedly give the benefit of their knowledge and experience trainee officers who would naturally ask them questions not out of academic interest but from the point of view of their actual experience and difficulties the discussion that will follow is bound to be interesting and instructive.

Domestic Enquiry - Essential of proper enquiry - Whether official having personal knowledge of acts of misconduct can held enquiry.

Do domestic enquiry into at of misconduct by work man need not be conducted in accordance with the technical requirement of criminal trials they must be fairly conducted and in holding them consideration of fair play and natural justice must govern  the conduct of enquiry officer

A ) enquiry must not be conducted by persons who had then fail witness the alleged incident the enquiry must be left to search officer of the employer who are not likely to import their personal knowledge into the proceeding which they are holding as enquiry officer

B ) add commencement abhi enquiry the employer should lead evidence against the work man charged give an opportunity to the work man to cross examine the and the explanation of the work man about biwi dance lead against him should be recorded the enquiry should not commence with cross examination of the work man himself

C ) the word man should be given due intimation of the date on which the enquiry is to be held so that he has an opportunity to prepare his defence at enquiry

D ) that any in constituency between the evidence given by a witness for the work man and another document for example the attendance register must be put to the witness and he should be given a chance to excellent search in constituency before the witness  is disbelieve .

E  ) where to separate domestic enquiry are held in respect of to work man the evidence recorded in 1 enquiry cannot be relied on when dealing with the case of the other work man.
